India’s Education Sector – Back to School

India’s US$40b education market is experiencing a surge in investment. Capital, both local and international, and innovative legal structures are changing the face of this once-staid sector

The liberalization of India’s industrial policy in 1991 was the catalyst for a wave of investment in IT and infrastructure projects. Rapid economic growth followed, sparking a surge in demand for skilled and educated workers. This, combined with the failure of the public system to provide high quality education and the growing willingness of the burgeoning middle class to spend money on schooling, has transformed India’s education sector into an attractive and fast-emerging opportunity for foreign investment.

Despite being fraught with regulatory restrictions, private investors are flocking to play a part in the “education revolution”. A recent report by CLSA (Asia-Pacific Markets) estimated that the private education market is worth around US$40 billion. The K-12 segment alone, which includes students from kindergarten to the age of 17, is thought to be worth more than US$20 billion. The market for private colleges (engineering, medical, business, etc.) is valued at US$7 billion while tutoring accounts for a further US$5 billion.

Other areas such as test preparation, pre-schooling and vocational training are worth US$1-2 billion each. Textbooks and stationery, educational CD-ROMs, multimedia content, child skill enhancement, e-learning, teacher training and finishing schools for the IT and the BPO sectors are some of the other significant sectors for foreign investment in education.

Opportunity beckons

The Indian government allocated about US$8.6 billion to education for the current financial year. But considering the significant divide between the minority of students who graduate with a good education and the vast majority who struggle to receive basic elementary schooling, or are deprived of it altogether, private participation is seen as the only way of narrowing the gap. Indeed, it is estimated that the scope for private participation is almost five times the amount spent on education by the government.

CLSA estimates that the total size of India’s private education market could reach US$70 billion by 2012, with an 11% increase in the volume and penetration of education and training being offered.

The K-12 segment is the most attractive for private investors. Delhi Public School operates approximately 107 schools, DAV has around 667, Amity University runs several more and Educomp Solutions plans to open 150 K-12 institutions over the next four years. Coaching and tutoring K-12 students outside school is also big business with around 40% of urban children in grades 9-12 using external tuition facilities.

Opening the doors

Private initiatives in the education sector started in the mid-90s with public-private partnerships set up to provide information and communications technology (ICT) in schools. Under this scheme, various state governments outsourced the supply, installation and maintenance of IT hardware and software, as well as teacher training and IT education, in government or government-aided schools. The central government has been funding this initiative, which follows the build-own-operate-transfer (BOOT) model, under the Sarva Shiksha Abhiyaan and ICT Schools programmes. Private companies such as Educomp Solutions, Everonn Systems, and NIIT were among the first to enter the ICT market, which is expected to be worth around US$1 billion by 2012.

Recently, the central government invited private participation in over 1,000 of its industrial training institutes and offered academic and financial autonomy to private players. Companies such as Tata, Larsen & Toubro, Educomp and Wipro have shown keen interest in participating in this initiative.

Regulatory roadblocks

Education in India is regulated at both central and state government levels. As a result, regulations often differ from state to state. K-12 education is governed by the respective State School Education Act and the Central Board of Secondary Education (CBSE) Rules and Regulations concerning affiliation and/or the rules of any other affiliating body. Under current regulations, only not-for-profit trusts and societies registered under Societies Registration Act, 1860, and companies registered under section 25 of the Companies Act, 1956, qualify to be affiliated with the CBSE and to operate private schools.

While the K-12 segment accounts for the lion’s share of India’s educational market, weaving through the complex regulatory roadmap to qualify for affiliation poses serious difficulties for investors. The CBSE requires privately-funded schools to be non-proprietary entities without any vested control held by an individual or members of a family. In addition, a school seeking affiliation is expected to have a managing committee controlled by a trust, which should approve budgets, tuition fees and annual charges. Any income accrued cannot be transferred to the trust or school management committee and voluntary donations for gaining school admission are not permitted.

Schools and higher education institutions set up by the trust are entitled to exemptions from income tax, subject to compliance with section 11 of the Income Tax Act, 1961. In order to qualify for tax exemptions, the trust needs to ensure that its predominant activity is to serve the charitable purpose of promoting education as opposed to the pursuit of profit.

Alternative paths

Alternative routes do exist for investors seeking to avoid the web of regulatory barriers that constrain their involvement. Sectors such as pre-schools, private coaching and tutoring, teacher training, the development and provision of multimedia content, educational software development, skill enhancement, IT training and e-learning are prime sectors in which investors can allocate their funds. These areas are attractive because while they relate closely to the profitable K-12 segment, they are largely unregulated. As such, they make attractive propositions for private investors interested in taking advantage of the burgeoning demand for quality education. Companies such as Educomp Solutions, Career Launcher, NIIT, Aptech, and Magic Software, are market leaders in these fields. Educomp recently acquired a large number of educational institutes and service providers across India. It has also formed joint ventures with leading higher education groups, including Raffles Education Singapore, for the establishment of higher education institutions and universities in India and China. Furthermore, it has entered into a multi-million dollar collaboration with Ansal Properties and Infrastructure to set up educational institutions and schools across the country and closed an US$8.5 million deal to acquire Eurokids International, a private provider of pre-school educational services in India. Gaja Capital India, an education-centric fund, has completed the funding of three education services companies in India. NIIT and Aptech, meanwhile, are engaged in the IT training business.

Core Projects and Technology is also focusing heavily on India and is likely to bid to takeover, upgrade and run public schools for specified periods on a public-private partnership basis.

Higher hurdles

While state governments are largely responsible for providing K-12 education in India, the central government is accountable for major policy decisions relating to higher education. It provides grants to the University Grants Commission (UGC) and establishes central universities in the country. The UGC coordinates, determines and maintains standards and the release of grants. Upon the UGC’s recommendation, the central government declares the status of an educational institution, which once authorized, is entitled to award degrees.

State governments are responsible for the establishment of state universities and colleges and has the power to approve the establishment of private universities through State Acts. All private universities are expected to conform to the UGC guidelines to ensure that certain minimum standards are maintained.

Amity University in Uttar Pradesh is one of the private universities to open its doors. It was approved by the Uttar Pradesh state legislature on 12 January 2005 under section 2(f) of the University Grants Commission Act.

Not-for-profit and anti-commercialization concepts dominate higher education fee structures. To prevent commercialization and profit-making, institutions are prohibited from claiming returns on investments. This, however, does not pose a hurdle for universities interested in mobilizing resources to replace and upgrade their assets and services. A fixation of fees is required in accordance with the guidelines prescribed by the UGC and other concerned statutory bodies. For this purpose, the UGC may request the relevant information from the private university concerned, as prescribed in the UGC (Returns of Information by Universities) Rules, 1979.

In line with the policy on Fee Fixation in Private Unaided Educational Institutions Imparting Higher and Technical Education, two types of fees are required: tuition fees and development fees. Tuition fees are intended to recover the actual cost of imparting education without becoming a source of profit for the owner of the institution. While earning returns on investment would not be permissible, development fees may provide an element of partial capital cost recovery to the management, serving as a resource for upkeep and replacement.

Legal precedents

In order to be awarded university status by the UGC, institutions must comply with the objectives set forth in the Model Constitution of the Memorandum of Association/Rules, and ensure that no portion of the income accrued is transferred as profit to previous or existing members of the institution. Payments to individuals or service providers in return for any service rendered to the institute are, however, not regulated.

In this context recent court judgments on private universities are relevant. The Supreme Court, in Unnikrishnan JP v State of Andhra Pradesh, introduced a scheme regulating the admission and levy of fees in private unaided educational institutions, particularly those offering professional education. The ruling was later notified in the fee policy.

Subsequently, in the case of Prof Yashpal and Anr v State of Chattisgarh and Ors in 2005, the Supreme Court assailed the Chattisgarh government’s legislation and amendments which had been abused by many private universities. It was contended that the state government, simply by issuing notifications in the Gazette, had been establishing universities in an indiscriminate and mechanical manner without taking into account the availability of any infrastructure, teaching facilities or financial resources. Further, it was found that the legislation (Chhattisgarh Niji Kshetra Vishwavidyalaya (Sthapana Aur Viniyaman) Adhiniyam, 2002) had been enacted in a manner which had completely abolished any kind of UGC control over private universities.

The Supreme Court concluded that parliament was responsible for ensuring the maintenance and uniformity of higher education institutions in order to uphold the UGC’s authority. Following the judgment, only those private universities that satisfied the UGC’s norms were able to continue operating in Chattisgarh.

Professional institutions

Professional and technical education in India is regulated by professional councils such as the All India Council for Technical Education (AICTE). Established under the AICTE Act, 1987, AICTE gives recognition to courses, promotes professional institutions, provides grants to undergraduate programmes, and ensures the coordinated and integrated development of technical education and the maintenance of standards. The AICTE has recently exerted pressure on unrecognized private technical and management institutes to seek its approval or face closure.

A single bench decision of the Delhi High Court in Chartered Financial Analysis Institute and Anr v AICTE illustrates the far-reaching implications this kind of pressure can have on all institutions operating independently of the AICTE. The court found that the Chartered Financial Analyst Institute, a US-based organization, was engaged in imparting technical education and that its charter, though not described as a degree or diploma, was nevertheless descriptive of the candidate attaining an academic standard, entitling him to pursue further courses, and achieve better prospects of employment in the investment banking profession. The AICTE argued that the Chartered Financial Analyst Institute fell within the ambit of its regulation and was therefore obliged to submit to the jurisdiction of the regulatory body. The Delhi High Court upheld the AICTE’s view that the Chartered Financial Analyst Institute did qualify as an institution imparting technical education..

This judgment may have emboldened the AICTE to proceed against a number of other establishments that are on its list of unapproved institutions. It holds particular significance since despite not granting degrees and diplomas, the Chartered Financial Analyst Institute was still deemed by the court to be covered under the description of a “technical institute”.

Enthusiasm grows for foreign participation

While regulators such as the AICTE continue to exercise influence in the Indian education system, the sector is expected to witness a surge in foreign investment and perhaps a reduction in the number of regulatory roadblocks as a result of the central government’s enthusiasm for overseas investors. Foreign direct investment in higher education could help reduce government expenditure and there is a general consensus that education as a whole should be opened for domestic and foreign private participation.

The entry of foreign educational institutions into India will be covered by the new Foreign Education Providers (Regulation for Entry and Operation) Bill. The bill seeks to regulate the entry and operation of foreign education providers, as well as limit the commercialization of higher education. Foreign education providers would be given the status of “deemed universities” allowing them to grant admissions and award degrees, diplomas or certificates.

Operationally, the bill proposes to bring foreign education providers under the administrative umbrella of the UGC, which would eventually regulate the admissions process and fee structures. Since these foreign institutions will have to be incorporated under central or state laws, they will also be subject to the government’s policies of reservations. The bill is pending approval from the Indian Parliament but it is unclear if it will be taken by the present government for a vote prior to the general elections in 2009.

Innovative structures unlock profitability

The regulatory restraints on running profitable businesses in the K-12 and higher education sectors have driven Indian lawyers to devise innovative structures that enable private investors to earn returns on their investments. These typically involve the establishment of separate companies to provide a range of services (operations, technology, catering, security, transport, etc.) to the educational institution. The service companies enter into long term contracts with the trust operating the institution. Payments made by the trust to the service companies must be comparative and proportionate to the services rendered by such companies. Furthermore, in order to qualify for tax exemptions, the expenses paid by the trust to the service companies must not exceed what may reasonably be paid for such services under arm’s length relationships.

Despite the regulatory constraints, the Indian education sector is on a path of exponential growth. A growing number of private companies are undertaking creatively structured projects in the education business and the level of investor confidence is demonstrated by the recent spate of M&A activity that has taken place.

With more domestic players emerging, the education sector is likely to witness consolidation, but at the same time, increasing foreign participation will drive competition and raise standards. Liberalization will continue to intensify as the government struggles to remedy its poor public education system and provide quality institutions to educate India’s masses.

Dogs and Cats Living Together

Dogs and cats are supposedly life-long enemies. Hence the phrase, “fighting like cats and dogs.” Having always owned both cats and dogs, I find the phrase and the premise to be far more inaccurate than accurate. Of course, we all know that there are those dogs that will simply chase every cat they see and those cats that will never tolerate a dog. However, it has been my experience that handled correctly, the vast majority of dogs and cats can live together. They may not learn to love each other; but they certainly can learn to tolerate each other’s presence. Dogs and cats that are raised with each other typically do fine their entire lives. They may actually accept an animal of another species more easily than one of their own, in that there are fewer fights over dominance and territory.

There are some dogs that should not be kept with cats. Dogs with a strong hunting heritage may always view cats as prey and may never be able to be trusted with any small animals. In addition to hunting dogs, terriers such as Jack Russells and pitbulls are often poor companions for cats. These dogs have an incredibly strong predatory instinct; they chase and attack moving objects without thinking about whom or what the object may be. Cats and other small pets are just too much of a temptation for these dogs.

Other dogs respond less to the animal than the situation and will leave alone a cat that sits still, but chase and attack one that moves. This is especially true of dogs that are kept outside. There is something about being out of the house that really pushes the hunting instinct into overdrive and will often result in even the most docile indoor dog attempting to chase cats once outside. So, one would not want to make the assumption that a cat and dog who tolerate each other indoors will do the same outside. The dog may decide to attack the cat. Finally, dogs that have a history of attacking cats are likely to do so again and should not be trusted with cats. If you are planning on rescuing a previously-owned dog, it is a good idea to get a history of the dog’s attitudes and behaviors around cats before bringing it into a house with cats. Many shelters will allow you to ‘test’ the dog by introducing it to a cat before completing the adoption.

Most cats, if they have had positive experiences with dogs, will tolerate canines in the house. Those that will not typically have had some prior negative interaction that is firmly embedded in their memories. Because most cats, even those that hate dogs, do not attack without provocation, these cats may be able to live with a dog. However, they probably will never bond with the dog, will avoid the dog at all costs, and will be pretty miserable. It is kinder to leave these cats in a feline-only household. Again, it is often possible to find out the history of a cat before adopting it, or to test the cat’s reactions to dogs in an adoption situation.

So which cats and dog can get along? The answer is just about all of the rest of them. In the best of circumstances, cats and dogs really become friends, playing and sleeping together. In other situations, cats and dogs may never be overly friendly, but they can learn to tolerate and behave themselves with other members of the family, including those of other species. As long as you are willing to work out a positive introduction and protect the animals from physical harm, these species usually get along. The process may take up to six or eight weeks, or even longer, but can be successfully accomplished.

If you are thinking of bringing a cat into a dog household, or vice-versa, there are steps that you can take to ensure the success of the relationship. First, because a dog can kill a cat, safety is your first concern. The dog needs to be able to be kept separated from the cat. This can be accomplished with a crate, or a separate room. The dog should have a refresher obedience course, so that it will sit, stay, and come to you when told, and leave the cat alone if ordered to. The dog needs to remember that the people, not the dog, rule the house. This way you can ‘explain’ to the dog, if necessary, that the cat is yours and needs to be treated with respect. In addition, the cat needs to have a safe haven. This means that the cat’s food and litter boxes need to be inaccessible to the dog and that the cat has places to run and hide. For example, leave a few bookcase shelves empty so the cat can climb to them, put a cat door into a closed bedroom, or use baby gates to separate the dog from the cat’s own room.

I keep my cats’ litter boxes, toys, scratching posts, water, and food in an extra bedroom. I use a baby gate to keep the dogs out of the room. I have cut a small cat-size opening into the closed mesh of the gate so that the cats can dash through it if necessary and not have to leap the gate. My dogs respect the gate, but if you have dogs that leap over it, you may need to cut the cat door into the room door or install a screen door with an opening large enough for the cats.

The initial meeting and first few weeks are critical times to set the tone for the future, so it is important to make all introductions go as smoothly as possible. The key is to remember that these animals will be together for a lifetime; there is no reason to rush their meetings. If bringing a cat into the house, provide the cat with its own bedroom for the first few weeks or longer. The litter box and food should be placed in this room. The dog in the house can smell the cat under the door, but has no real need to meet the new member of the family until the cat is comfortable and bored with its personal space. If this is a young kitten, they may end up living in this room for several more weeks. Once the cat is doing well in its own room, you can let the cat explore the house, undisturbed by the dog. You can actually put the dog in the cat’s room while the cat is out, so that the dog really gets to experience the cat’s scent without bothering the cat. You can also get the pets used to each other’s scents by swapping toys, towels, or other items between them.

The initial face to face meeting should be done after the new cat is familiar with the entire house. Make sure that the dog is on a leash and under control. Have another person near the cat to provide help, if needed. Keep the meeting short and positive. Praise the dog for being wonderful around the cat. Use food rewards if appropriate and make sure that the dog understands that good things happen when the cat is present. After a few, short positive meetings, it is time to let the cat explore for longer periods, with the dog present and on the leash. If this step proceeds calmly, let the dog off the leash and watch the interactions. Make sure you are always there to stop any problems before they can accelerate. Do not allow the dog to be aggressive in any way to the cat, and lavishly praise the dog for good behavior. Be certain that the cat has access to hiding places. If aggression occurs at any stage of the introductions, return to the previous stage and slow down. Even if all looks great, do not leave the cat alone with the dog until you are truly positive that everything is running smoothly. This means that if they cannot be supervised, the cat should be left in its bedroom or the dog kept crated.

Bringing a dog into a cat household is relatively easy. The dog should be kept on a leash for the initial introductions and never left unsupervised. Make sure that all animals are praised for their wonderful behavior when they are together. As previously discussed, the dog can be crated or the cat left in a bedroom when they cannot be watched. Since the cat is already familiar with its territory and the dog is a newcomer, the dynamics of the relationship often turn in the cat’s favor, making the transition relatively easy.

Puppies and kittens do present unique challenges. Kittens must be protected from dogs at all times simply because any dog is big enough to badly hurt or kill a young kitten. A kitten must always be closely supervised even around the best behaved of dogs. Provide the kitten with appropriate toys of its own. Do not let the kitten ‘play attack’ the dog or chase it. This can rapidly escalate into a dangerous situation. For the same reason, do not let the dog ‘play’ with the kitten. The kitten must be kept in a safe room when an adult it not home. My kittens stayed in their own room when I was not at home and at bedtime until they were approximately six months old.

Rambunctious puppies may also be a problem. Without meaning to, an energetic puppy can harm a kitten or even an adult cat. It is up to you to make sure that their interactions are monitored so that no one gets hurt. It is also really important to exercise and play with the puppy routinely. Make sure the puppy has its own toys and uses them. A tired puppy is less likely to bother the cat and less likely to be a behavior problem in the house.

It takes work, patience, and time to introduce cats and dogs to each other. However, the positive outcome is well worth the work. My cats and dogs play, eat, relax, and sleep together. I get tremendous pleasure watching them. You will be pleasantly surprised how much positive energy is brought into your home by having both cats and dogs living there.

Save the Children

The poet Oscar Wild, wrote these moving lines: “Children begin by loving their parents. After some time, they judge their parents. Rarely, if ever, do they forgive them”. It is a well known fact that the well-being of today’s children is inseparable from the peace, progress and prosperity of tomorrow’s world. It is, therefore, important that children be nurtured in an environmentally sustainable pattern to promote national and global peace and progress. The importance of their welfare was underlined during the World Summit for Children in September, 1990, held under the auspices of the United Nations International Children Education Fund (UNICEF) where world leaders maintained that “unless the investment in children is made, all of humanity’s most fundamental long-term problems will remain fundamental long term problems”.

Put succinctly, children are a country’s most precious assets and they demand the highest priority on both national and international investments. In spite of this open acknowledgment of the importance of their survival to our collective global future, evidence abounds that children are facing the worst tragedy in the world today. In a recent seminar organised by the United Nations non-government liaison services in Geneva, participants at the seminar from more than 120 countries were in agreement that “millions of children around sub-Saharan Africa live under especially difficult circumstances where special protection measures are required to enable them enjoy fulfillment of their basic rights”. These children in addition to being poor, are exploited, abused, abandoned, neglected, disabled and deprived of liberty.

The greatest manifestations of child abuse, exploitation, deprivation and neglect are very obvious in situations where children are used as a veritable source of cheap labour, soldiers, and prostitutes against their innocent and passive will. Many children seldom report cases of such abuses against them and most child abusers rely on this fact to continue in their wicked acts. Child labour thrives in our societies today mainly because some employers consider it cheaper to employ and over-work children who have very weak resistance to exploitation and oppression than adults. Such employers often betray and take undue advantage of the innocence of children’s dependence and trust. Families also use child labour to make additional income. While some of the hapless children are engaged in domestic duties of hawking goods, others are made to do hard labour meant for adults. Some Non-Governmental Organisations, (NGOs) have continued to express their concern over this unfair practice that is conducted not only in Nigeria, but also in other countries of the world. In an interview granted to a newsmagazine, Mr. A.C. Onukwue, a director of Media Environment Initiative (MEI) in Nigeria said that “children as young as eight years old are being subjected to a bland agreement by their parents to serve as slaves all their childhood and youths in the name of apprenticeship”.

Those working as domestic servants are the most exploited and most difficult to protect. Most of them are girls who live with their employers and are totally dependent on them. The United Nations Organisation (UNO) and the Organisation of African Unity (OAU) have made some legal provisions in their bid to checkmate this growing monster. Article 32 of the United Nations Convention of the rights of the child and article XV of the Organisation of African Unity Charter on the rights and welfare of the child, unanimously condemn child labour in all its ramifications. The two articles recognize “the rights of the child to be protected from economic exploitation and from performing any work that is likely to be hazardous, or to interfere with the child’s education or physical, mental, spiritual, moral or social developments”. In Asia, South America and some migrant communities in the United States, it has been reported that children even as young as five years of age are forced into what can be termed “slave labour”. They work like little robots in dreadful conditions that damage their immature bodies and minds. Most of them have no education, are homeless and deprived of parental love and care.

Children as Child-Labourers

Most people have argued that the main cause of child labour is poverty. Others are economic and social inequality, war, unemployment, broken homes and juvenile delinquency. The merchants of children peddle stories of pleasurable life awaiting the kids in the cities in order to entice their victims from their poverty-stricken parents. Most poor parents swallow such stories hook, line and sinker and so inadvertently release their children to the slave merchants. Because of the nature of their minds, children believe what they are told by adults without reservation. Some of them on hearing such false stories of bright future awaiting them at imaginary lands, sometimes sneak away from their homes to be taken away without their parents’ knowledge. Most of them also follow child merchants because their parents find it difficult to feed, clothe and train them in school. Though many children in the advanced industrial nations and in some urban centers of the Third World countries enjoy good care and welfare, yet it is obvious that majority of them in some rural and urban areas whose parents are living below subsistence level are more often exposed to this risk. The situation has been considered dangerous enough that it was brought to focus in 1997 at a forum organised by the International Labour Organisation (ILO) and the United Nations International Children Education Fund (UNICEF) for jourlalists in Lagos to deliberate upon. The theme of the forum was The Impact of Child Labour on Development. Participants at the forum agreed that child labour exists in Nigeria as in other parts of the world. It is interesting to note that most of these unsuspecting children lured from their homes in Nigeria are taken to Gabon in Central Africa and other neighbouring countries where they are subjected to the highest form of child abuse.

Children as Articles of Trade

But how widespread are cases of child abuse? Let us at this stage, embark on a historical excursion in order to reveal the extent of abuse and danger our children had been exposed to. On May 30, 1995 when 330 Nigerian deportees arrived in Calabar from Gabon, 109 of them were children below 16 years of age. Again, in March 1996, four students of Ikono Ibom Comprehensive Secondary School, Ikot Aya, Akwa Ibom State, Nigeria were cajoled into embarking on a trip to Gabon by a fellow student. But these students, made up of three girls and a boy whose ages were between 10 and 14 years were lucky as they could not reach their destination. As fate would have it, officers of Nigerian Immigration Service intercepted their boat at the Oron Creek. And in January 1997, 150 Gabon-bound children were rescued from a camp at Mkpanak near Ibeno. Among the children aged between 11 and 18 years were 20 Nigerians. The rest of them came from neighbouring Togo, Benin Republic and Ghana. In February 1997, 86 under aged children were freed after a raid on an uncompleted building at Ibeno, Akwa Ibom State. It was reported that the nefarious dealers on children had intended to ship them to Gabon before they were rescued. A breakdown of the rescued children’s nationalities showed that 25 were from Nigeria, 23 from Togo while 38 were from Benin Republic. Of the 86 kids, 46 were girls.

It is also sad that not all of these children had been lucky. The hapless ones do not get to their destinations and do not live to tell their stories. In January 1996, more than 200 persons perished in the high seas of Ibeno Beach. About 73 per cent of the victims were school children, some of whom were in their school uniforms. These difficult circumstances represent serious hazards and risks to the survival and development of our future generation.

Children as Sex Tools

Apart from child labour and trafficking, sexual harassment is another area of high risk that confronts our children. Convincing indication of the enormity of this crime was tendered at the World Congress Against Commercial Sexual Exploitation of Children held in Stockholm, Sweden, in 1996 which was attended by representatives of 130 countries. For instance, it was documented that in several parts of the world, there are millions of young girls, some even as young as 10 years of age who are constrained to work as call girls. After years of physical, mental, and emotional molestation, these girls are scarred for life. In most cases, they surrender to this atrocity simply because they want to eat and stay alive. The option is like choosing between six and half a dozen. As a result of such abuse, some children develop social and psychiatric problems later in life. Furthermore, the activities of pedophiles who occupy influential positions in our society do not help matters. Pedophile refers to a psychological disorder which causes adults to be sexually attracted to children whose sexual experience is nil. In August 1997, a Dublin Chief Judge, Cyril Kelly, committed Reverend Berndan Smith a 72 -year old Roman Catholic priest to 12 years imprisonment for a case involving 74 count charges of indecent and sexual assaults against children. Rev. Smith who admitted to a 36-year career of sex offenses against a total of 26 children in the Republic of Ireland, pleaded guilty to the charges. The Daily Telegraph of June 2, 1998 carried a report on a 44-year old soccer coach who used his position of trust to abuse young boys. He was jailed for nine years after pleading guilty to 23 specimen charges against children. The Chester Crown Court was told that from 1978 to 1992, the coach invited boys from the North West and Midlands to stay with him or go on holiday to North Wales and Spain where the offenses took place. According to The Daily Telegraph: “Benndell would take the boys into his trust by offering them the chance of not only training with his teams but also an occasion at Grewe Alexandra and Manchester City”.

Children As Child Soldiers

Compounding the tragedy further, there has been an increase in the use of child soldiers in guerrilla armies. Children are easily kidnapped, separated from their parents and siblings and conscripted into the army to fight wars. In such situations they are systematically brutalized, at times by being forced to watch gruesome murder. Some have been ordered to kill their own parents, brothers and/or sisters. Where they find it difficult to carry out these bloody assignments as a result of their innocence, such children are encouraged and compelled to take drugs in order to heighten their killer instinct. In Freetown, Sierra Leone, child soldiers whose innocence had been destroyed by the crimes of a protracted civil war resolved that they were not going to hands-off arms. They took the resolution in October, 1998 when Carol Bellamy the then UNICEF’s head in Sierra Leone, asked them in Bo to surrender their weapons. The child soldiers belonged to the hunter militia group known as Kamajor. In addition, children generally suffer a high death rate during civil or international wars. Most of them die of hunger or hunger related diseases such as kwashiorkor. Because they are fragile and defenseless, they are easy victims in war situations. On August 31, 1997 about 21 children fell into a swimming pool in panic and got drowned in Nsele, 60 kilometers east of Kinshasa, capital city of the Democratic Republic of Congo when some armed troops tried to maintain order in the area. In Northern Uganda, rebels of the Lords Resistance Army (LRA), headed by Joseph Kony, who have been fighting against the Ugandan government have continued to carry out atrocities against children in that country.

It is interesting to note that children are gradually becoming aware of the injustice and oppression against them by the adult world. In July 1997, Eric Ndelema, a councilor from Kaziso, West Rand, was stoned to death by an irate mob of about 200 primary school children. The mob also set his house ablaze. Mary Martins, a sergeant and South African Police spokesman, confirmed the incident that occurred in Johannesburg but said that the motive for the attack was not yet known. If the cause of the attack was not known, perhaps the peaceful demonstration that was carried out by children from January 5 to June 4, 1998 is enough proof that children are gradually getting fed up with the whole game. Pakistan played host to the global march against child labour in April, 1998 as part of a campaign to draw world attention to children’s rights. The campaigners, numbering about 45,000 children from various countries, walked through Manila, Vietnam, Thailand, India and Geneva into the boarder town of Wahgah, 25 kilometers from Lahore, capital of Pakistan, amidst cheers from the citizens. Kailash Trithay, the leader of the demonstration said his group was carrying a message from every working child that “the world should be free of child abuse”.

In spite of the above facts, which are by no means exhaustive, it appears that not many countries of the world have taken definitive stand against this global monster of child abuse which is threatening to turn our God-given children into slaves and make this world an unsafe place for those who are undoubtedly our leaders of tomorrow. The situation quickly calls to mind, the admonition of an erudite scholar, Martin Luther King, who once remarked that “the world is full of evil today not because of those who do evil, but because of men who keep silent and watch evil being done”.
